Terms of Service

1. Acceptance of Terms

By accessing or using DataXGen AI, you accept and agree to be bound by these Terms of Service. If you don't agree, please don't use the service.

2. Description of Service

DataXGen AI is a business data platform. Each customer's business runs in its own Space — a tenant boundary holding its own boards, records, documents and files. The service includes:

• Live boards and record pages for your business data
• Documents whose figures stay bound to the query that produced them
• An AI Operator that reads and acts on your Space's own data at your request, and never without your explicit confirmation
• Automations you define, and reporting across your data
• Optional integrations (Gmail, Google Drive, Shopify, WordPress/WooCommerce, webhooks) you can connect and disconnect yourself in Settings

3. Eligibility

You must be at least 18 years old to use DataXGen AI. If you use it on behalf of a company or other organization, you confirm that you have the authority to accept these Terms for it, and "you" includes that organization.

4. User Accounts

You are responsible for:

• Keeping your account credentials confidential
• All activity that occurs under your account
• Telling us immediately about any unauthorized access
• Providing accurate and complete account information

If you invite team members into a Space, you decide what they can see and do there, and you are responsible for their use of it.

5. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems, or to another customer's Space
• Interfere with or disrupt the service
• Use automated systems to access the service without permission
• Share your account with others
• Send spam, or email people who have not agreed to hear from you, through any feature of the service
• Upload malware, or content that infringes someone else's rights
• Reverse engineer the service, or use it to build a competing product

6. Your Data

You keep ownership of everything you put into your Space. You give us a limited permission to host, copy, process and display that data only as needed to provide the service to you, keep it secure, and meet our legal obligations. You are responsible for having the right to the data you upload, including any personal data about other people, and for getting any consent the law requires.

Your use of DataXGen AI is also governed by our Privacy Policy, which explains how we collect, use and protect data.

7. The Operator and AI Output

Answers, figures, drafts and other output the Operator produces for you are yours to use. AI output can be wrong, so review it before you rely on it or send it to anyone. The Operator does not change your data without your explicit confirmation, and you are responsible for the changes and messages you approve.

8. Third-Party Services

Integrations you choose to connect (such as Gmail, Google Drive, Shopify or WordPress) are provided by other companies under their own terms. We are not responsible for those services, and disconnecting one stops our access to it.

9. Intellectual Property

All content, features and functionality of DataXGen AI, apart from your data, are owned by us and protected by intellectual property law. You may not copy, modify, distribute or create derivative works from them without our express permission. If you send us feedback or suggestions, we may use them without any obligation to you.

10. Subscription and Billing

If you subscribe to a paid plan:

• Fees are charged in advance on a recurring basis, through Stripe
• Plans include a free trial period, shown at signup
• Your subscription renews automatically until you cancel it
• You can cancel at any time; access continues until the end of the period you paid for
• Refunds are given at our discretion, except where the law requires one
• We may change pricing with 30 days' notice; the change applies from your next billing period

If a payment fails, we may pause your account until it is settled.

12. Limitation of Liability

To the maximum extent permitted by law, DataXGen AI is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

13. Indemnification

You agree to defend and indemnify DataXGen AI against claims, losses and costs (including reasonable legal fees) that arise from the data you put into the service, the messages you send through it, or your breach of these Terms.

14. Termination

You may stop using the service and close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, if a payment stays unpaid, or if we have to for legal reasons. Before an account is closed, you can ask us for an export of your Space's data. After closure we delete your data as described in the Privacy Policy. Sections 6, 9 and 11–17 continue to apply after termination.

15. Changes to Terms

We may modify these Terms of Service at any time. We'll notify you of significant changes by email or through the service. Continued use after a change means you accept the new terms.

16. Governing Law and Disputes

These Terms are between you and DataXGen AI. If a dispute arises, please contact us first; most concerns can be resolved quickly and informally. These Terms are governed by the laws of Bangladesh, and any dispute that we cannot resolve together will be heard by the courts of Bangladesh. Nothing in these Terms limits any rights you have under the consumer protection laws of the country where you live.

17. General

• These Terms, together with the Privacy Policy, are the entire agreement between you and us about the service
• If any part of these Terms is found unenforceable, the rest stays in effect
• If we don't enforce a right straight away, we have not given it up
• You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of our business
• Neither of us is liable for delays caused by events beyond reasonable control

18. Company

DataXGen AI is operated by an individual, as a sole proprietorship based in Bangladesh. The service is hosted on servers in the United States.
